Статья посвящена актуальным вопросам, связанным с самозащитой человеком своих прав. Определено, что самозащита представляет собой неотъемлемое естественное право каждого человека, выступающее первой линией защиты до вмешательства юрисдикционных инстанций. Подчеркнуто, что самозащита является самостоятельным правовым институтом, который носит межотраслевой характер и позволяет правовому механизму самозащиты адаптироваться под специфику конкретных отраслевых правоотношений. Отмечено, что юридическая конструкция самозащиты прав человека опирается на закрепленный законом механизм самостоятельного пресечения нарушения и защиты прав без обращения в государственные органы. Исследован вопрос о фундаментальных подходах к пониманию природы самозащиты прав человека. Акцентировано внимание на таких фундаментальных подходах, как естественноправовой, позитивистский, либертарно-юридический, социологический, международно-правовой. Сделан вывод о том, что институт самозащиты является комплексным межотраслевым средством защиты прав человека, действия которого возможны независимо от органов государственной власти, что и является не только определяющим фактором, но и его основной отличительной чертой.
The study is devoted to topical issues related to a person’s self-defense of their rights. It is determined that self-defense is an inalienable natural right of every human being, acting as the first line of defense before the intervention of jurisdictional authorities. It is emphasized that self-defense is an independent legal institution, which has an interdisciplinary character and allows the legal mechanism of self-defense to adapt to the specifics of specific sectoral legal relations. It is noted that the legal structure of self-protection of human rights is based on a legally established mechanism for the independent suppression of violations and protection of rights without recourse to State authorities. The issue of fundamental approaches to understanding the nature of self-protection of human rights is investigated. Attention is focused on such fundamental approaches as: natural law, positivist, libertarian law, sociological, international law. It is concluded that the institution of self-defense is a complex interdisciplinary means of protecting human rights, whose actions are possible independently of public authorities, which is not only a determining factor, but also its main distinguishing feature.
